Terms and Conditions

Booking and Payments: A non-refundable deposit comprising 51% of the total rental fee plus relevant taxes is necessary to confirm and secure a booking. The remaining amount is due 60 days before the date of arrival. For reservations made within 60 days of arrival, the complete rental fee and applicable taxes must be paid when booking.

Cancellation Terms: Any cancellations 60 days or less from the scheduled arrival date are non-refundable, irrespective of the cause, including health issues or travel complications. We highly advise that the Guest consider purchasing comprehensive travel insurance to protect against unexpected situations.

Check-in and Check-out Timings: Guests can check in anytime after 4:00 pm on the day of arrival and are expected to check out by 11:00 am on their day of departure. Early arrivals or late departures may be welcome at properties with a community pool and other common facilities.

Amenity Access: Guests can enjoy their rental property and any communal amenities, like a pool or shared spaces, provided they're available at the property for their stay. For Guests staying at Flora Farms and The Oliver in Phoenix, this includes access to the Community Pool. Guests residing at The Oliver in Cabo can use the alfresco dining area and terrace. Please note that other properties under Coveted Stays may not offer common areas.

In accordance with applicable laws and insurance and liability compliances, we are required to publish the following Additional Rules, Terms, and Conditions.

Rental Platform Acknowledgement: The Primary Guest, having reserved this Lodging through an online platform, such as Coveted Stays, CovetedStays.com, Airbnb, Vrbo, Booking.com, or any other similar platform (hereinafter referred to as the "Rental Platform"), hereby agrees to be bound by the terms and conditions of the Rental Platform, including but not limited to the reservation Check In and Check out dates and times, as well as the terms and conditions herein.

Occupancy: The Guest is limited to the maximum occupancy of the property it is booking. Before arrival, the Guest will be requested to provide the names of all individuals staying at the property during the reservation period. Occupancy by persons not provided shall not be permitted on the property without prior written approval.

Harvesting Restrictions: We recognize the allure of the diverse edible plants that adorn the landscapes of many Coveted Stays properties, particularly Flora Farms. However, Guests (and their companions) are prohibited from picking any herbs, fruits, or other plants at the property. "Harvesting Privileges" are granted solely to the property’s deeded fractional real estate owners.

Weapons and Firearms Prohibited: Weapons, including but not limited to firearms, are strictly prohibited on the Lodging premises. Any policy violation will result in immediate termination of this Agreement, and the Guest(s) will be required to vacate the Property immediately.

Recreational Lodging Only: The Lodging shall be used and occupied by Guests exclusively as a recreational, residential residence. The Lodging shall not be used at any time to carry on any business, profession, trade, or purpose other than as a short-term and recreational residence.

Lodging Fee: The Primary Guest shall pay the rental fee for the Lodging per the terms and conditions of the Rental Platform, including any applicable taxes or fees. The Innkeeper shall not be held responsible for any discrepancies or disputes related to the rental fee or payment terms established by the online booking platform.

No Smoking or Vaping: No smoking or vaping of any kind is permitted on the Lodging premises. This includes the interior and exterior areas of the Lodging. Violation of this provision shall be considered a material breach and grounds for immediate termination of the Agreement.

No Pets: Unless otherwise agreed to by the Innkeeper in writing, no pets are allowed to reside, visit or occupy the Lodging. Guests agree not to keep or permit any pets on the Lodging.

No Events, Parties, Gatherings, Meetings, or Celebrations: The Guests must not hold events (such as parties, celebrations, or meetings) at the Property without the advance written consent of the Innkeeper. Any of these cases will allow the Innkeeper to terminate the Agreement without providing a refund of any payment the Primary Guest has paid for the booking, and the Innkeeper will not be legally responsible to find any alternative accommodation.

Good Conduct: The Guests shall behave respectfully and shall be good neighbors respecting the rights of the surrounding Property. Creating a disturbance of the above nature shall be grounds for immediate termination of this Agreement.

The Accordance of Local Laws: The Guests agree to abide by all rules and regulations set forth by local laws, including but limited to the Guests' commit to not to use the Property for any illegal or commercial purpose, including but not limited to sub-lease the Property or otherwise allowing anyone or more people to stay above the maximum permitted or if not previously agreed with the Innkeeper; and the Innkeeper can refuse to allow the Guests into the Property or ask the Guests to leave the Lodging and the Lodging Property if they reasonably believe the one or both of the Guests when applicable, or any other person invited by the Guests to the Property, are behaving illegally may likely to be caused, has been caused, or is being caused as a result of the behavior of the Guests (or any other person invited by the Guests to the Property).

Innkeeper Access: The Guests must allow the Innkeeper or their representative (including workmen), with reasonable notice, access to the Property at any reasonable time during their stay (except in an emergency or if a problem needs sorting out quickly and you cannot be contacted in time. In these situations, the Innkeeper can enter the Property at any time without giving you prior notice).

No Physical Alterations: The Guests are strictly prohibited from making any physical alterations or changes in or to the Lodging or the Lodging Property.

Compliance with Lodging Rules: The Guest agrees to comply with all rules and regulations outlined in this agreement and/or within the Rental Platform.

Termination and Refund Policy: Any Guest who violates any of the terms and conditions of this Agreement may be asked to vacate the Property immediately, without a refund, except for the Security Deposit as per the "Security Deposit" clause of this Agreement. The Innkeeper reserves the right to terminate this Agreement and the Guest's (or Guests' if applicable) occupancy of the Property at any time for any lawful reason, including but not limited to violation of any of the terms and conditions of this Agreement, non-compliance with local laws and regulations, or any other conduct that the Innkeeper deems to be detrimental to the safety and well-being of other Guests and/or operators and staff of the Lodging. If any Guest is asked to vacate the Property, the Primary Guest will not be eligible for any refund or compensation except as provided in the “Damage Deposit" clause of this Agreement.

Recreational Lodging Agreement: Before check-in, the Guest must electronically sign a Recreational Lodging Agreement per applicable laws and insurance and liability compliances. This agreement, outlining all of the terms and conditions herein, will also contain a link to pay a refundable Damage Deposit, which is standard practice in the hotel and hospitality industry.

Use of Damage Deposit: The Host shall hold the deposit without liability for interest and as security for the performance by the Guest of the Guest's obligations under the Recreational Lodging Agreement. The Host may, but is not obligated to, use, apply, or retain all or any part of this deposit to pay for any obligations of the Guest, including but not limited to unpaid services, products, and/or any damage to the Property caused by the Guest or its invited occupants.  

Liability for Loss and Damages: The Innkeeper has fully furnished the Lodging per the description and photos provided on the Rental Platform. The Primary Guest shall be solely responsible for any damages, misplacements, or repairs beyond ordinary wear and tear to the Lodging and its contents (collectively referred to as "Contents"). The Contents shall include, but not be limited to, the items listed and replacement values, including a markup of 15% to compensate for expenses related to the procurement of said Contents. The Primary Guest may request a copy of the list of the Property’s primary contents and photos —which he/she/they will be required to inspect and verify within the first three hours of arrival. Failure to notify the Innkeeper of any discrepancies within this period shall be deemed acceptance of the Contents in good condition. The Innkeeper may deduct from the Security Deposit for any repairs and/or replacement of the Lodging and/or Contents during the Guest’s stay, including additional dates if the Guest chooses to stay longer. If the damages, misplacements, or repairs exceed the Security Deposit, the Innkeeper shall reserve the right to take further legal action against the Primary Guest, including but not limited to seeking additional compensation.

Return of Damage Deposit: The deposit shall be refunded to the Guest, without interest, and less any set off for unpaid amounts owed by the Guest to the Host, within 7 to 15 days of the date that the Guest has vacated the Property. If the Host deducts any amounts from the deposit, a detailed list of the deductions shall be provided to the Guest along with the deposit balance, if any. 

Innkeeper’s Lien: The Innkeeper is providing transient recreational lodging to the Guests, and the Guest agrees to give the Innkeeper ha lien on the baggage and other property of the Guests brought to the Property by the Guests for charges due for accommodation, board, lodging or things furnished at the request the Guests, with the right to possession of the baggage or other property until the charges are paid and which the Damages Deposit does not cover. And if any such sums due remain unpaid for 30 days, the Innkeeper may sell the baggage or other property at public auction and apply the proceeds towards any sums due.

Jurisdiction: Any disputes that emerge concerning this Agreement will be governed by and construed per the laws of the State of the country where the property is located, and any ensuing legal proceedings will be conducted within that same jurisdiction. The provisions of this indemnification will continue to be in effect even after the conclusion or termination of this Agreement.

Guest’s Agreement: the Guest's agreement to the terms and conditions outlined herein is implicit, irrespective of whether the Recreational Lodging Agreement has been formally signed electronically. By proceeding with this booking through any Rental Platform, the Guest has consented to all terms and conditions described herein, including, but not limited to, the subsequent Release of Liability.

Affirmation of Liability Release: By securing an accommodation through Coveted Stays, I, the Primary Guest, commit to indemnify, defend, and absolve the Innkeeper, the Property, its proprietors, their representatives, agents, management team, and officers from all claims, liabilities, damages, costs, and expenses, inclusive of reasonable attorney's fees, arising from or associated with any accident, injury, or damage that may occur during my occupancy of the Property. This extends to situations related to the absence of safety protections of any kind. Moreover, if I am securing an accommodation at Flora Farms, The Oliver in Phoenix, or The Oliver in Cabo, I, the Primary Guest, recognize and acknowledge that the Lodging features Aquatic Amenities, which may include a swimming pool, hot tub, and/or ponds. In this context, I am aware that no lifeguard services will be provided at these Aquatic Amenities. My utilization of these amenities confirms my physical fitness and proficiency in swimming to a degree that does not pose a risk to myself or others, even in water of substantial depth. I accept that activities involving swimming and the use of Aquatic Amenities inherently carry risks, including but not limited to death, severe physical injury, and other potential hazards due to weather conditions, the state of the Aquatic Amenities, accidents, health emergencies such as heart attack or stroke, the behavior of other participants, and the possibility that no assistance may be available if I am injured. I voluntarily choose to use the Aquatic Amenities, fully aware and accepting of these risks. Furthermore, I assert that any other companions accompanying me will use the Aquatic Amenities voluntarily and at their own risk. I accept all risks for myself and any such companions, including but not limited to my spouse, children, parents, siblings, and any potential inheritors (“my Family”). On behalf of myself and my Family, I permanently renounce, discharge, and abandon any and all rights and claims of any sort, whether monetary or otherwise, compensatory or punitive, that I or my Family currently have or may have in the future against the Innkeeper and its officers, and the Property Innkeeper and its officers. I acknowledge that the Property and all of the Aquatic Amenities lack child safety barriers or safety protections of any kind. Notwithstanding, I voluntarily opt to stay at the Property, fully understanding the potential hazards and risks involved. I hereby absolve and indemnify the Innkeeper and its officers from all liability associated with any accidents or injuries that may occur during my stay at the Property, including those associated with the lack of safety protections.
